Terms and conditions
The deal in plain English. These terms apply when you sign up to an ONYA plan. If anything here clashes with what we've agreed with you in writing, the written agreement wins.
Who you're dealing with
ONYA is run by Amelia Babidge, a sole trader trading as Onya Websites (a Fusco Studio brand), ABN 39 596 248 058, 5 Birchall Rd, Goolwa Beach SA 5214, Australia. Contact us at hello@onyawebsites.com or 0447 123 690.
What you get
Sorted (from $49 a month): a website built for your business, your web address set up for you, hosting, the security padlock (SSL), basic search engine set-up, an enquiry form that sends to your inbox, ongoing care, and one change a month.
Flash (from $69 a month): everything in Sorted, plus a scroll-animated hero film and premium animations.
“From” means the standard build. If you need something bigger, such as extra pages or features, we quote you before any work starts and nothing changes unless you agree. Prices are in Australian dollars.
What we need from you
- Your logo, photos, business details and anything else we ask for to build the site.
- Only send us content you own or have permission to use. You're responsible for making sure the photos, logos and words you give us don't break anyone else's copyright or rights.
- Accurate details. Licence numbers, prices and claims about your business that appear on your site are your call and your responsibility.
We usually have a site live within 7 days of getting everything we need. Waiting on content is the main thing that slows it down.
Approving the site and when you start paying
There's no deposit and no set-up fee. We build the site and send you a preview link. When you're happy, you approve it, it goes live, and your first payment is due then.
If we've had a proper go at fixing what you don't like and it's still not right, you can walk away before approving it. You won't owe us anything, and the design stays with us.
Payments
- Monthly plans are paid monthly in advance, starting from the day the site goes live.
- Yearly plans are paid in one go, at 15% off the monthly price.
- We'll agree the payment method with you when you sign up.
- If a payment fails, we'll let you know. If it's still unpaid 14 days later, we may take the site offline until it's sorted.
Changes to your site
One change a month is included, like updating prices, swapping photos or editing text. Extra changes are $15 each. Bigger jobs, like a whole new page, are quoted first.
Price changes
There's no automatic price rise after your first year. If we ever need to change a price, we'll tell you in writing at least 30 days before it applies, and you can cancel with a month's notice if you don't want to continue.
Cancelling
There's no minimum term, no lock-in and no exit fee. Give us a month's notice by email at any time. Your site stays live until the end of the notice month, then comes down. See our refund policy for yearly plans.
Who owns what
- Yours: your domain name (registered in your name), your words, your photos, your logo and your business information. They always go with you.
- Ours: the website itself (its design and code) stays with us while you're on a plan. We license you to use it for as long as you're subscribed.
- Buying it out: if you'd rather own the site outright, you can buy it out. We'll quote you a fair price first.
When you leave, we'll help you move your domain and hand back your content.
What we can't promise
We set your site up so Google can find it, and we help with your Google Business Profile. We can't guarantee search rankings, a number of calls or enquiries, or any amount of new work: those depend on things outside our control, like Google, your competition and your area.
We use a reliable host and keep an eye on your site, but we can't promise it will never be offline. If it goes down, we'll work to get it back up as soon as we can.
Your rights under the Australian Consumer Law
Our services come with guarantees that can't be excluded under the Australian Consumer Law, including that we'll provide them with due care and skill and within a reasonable time. Nothing in these terms takes those rights away.
Where the law allows, if something goes wrong our liability is limited to supplying the service again or paying the cost of having it supplied again. We aren't liable for indirect losses, such as lost profits, except where the Australian Consumer Law says we must be.
Ending the agreement
We can end a plan with a month's notice, or straight away if a site is used for anything illegal or harmful. If we end it without a good reason on your side, we'll refund any payment for time after it ends and help you move your domain and content.
Changes to these terms
If we change these terms, we'll update this page and tell current clients by email at least 30 days before the changes apply. If you don't agree, you can cancel with a month's notice.
Law
These terms are governed by the laws of South Australia.
